Commercial Use of "Cartoonising" Poses

Apologies if this is something that is obvious or has been explained elsewhere - I spent almost 2 hours reading through previous posts, the licensing, FAQ and the unofficial FAQ but just couldn't find a clear answer (or one that I could understand as I have no knowledge of modelling terminology so am finding some of the wording hard to get my head around).

I am using Make Human 0.9.1 RC1 so that I can pose the model - what I'm not really sure about is:

1. If I take a screen shot of the model in a given pose and then use Adobe Illustrator to create a traced and coloured cartoon version of that pose, can I sell that cartoon image?
2. If I can sell that cartoon is the statement "This content is based on the MakeHuman mesh" required to be displayed somewhere around/on/below the cartoon?
3. Would this work be under the same license as the GNU General Public License 3.0 - does this mean although someone might buy what I create they can then just pass it on freely?

Again, apologies if these questions are obvious!

Assuming the license for 0.9.1 is the same as the current one (I don't remember), my interpretation of the license is the following:

  • Yes you can sell any piece of static art you generate. The special exceptions only apply if you make another character generator software, not to art you produce by using MH as a tool
  • No you don't need to mention MH at all, although it'd be polite to do so
  • No, your art would not fall under GPL. You own the produced art and are free to set any license you wish on it.

But as said, that's only my interpretation.

The relevant paragraph in the license text ( http://sites.google.com/site/makehumandocs/licensing ) is:

You own any 2D images that you create using exported MakeHuman mesh data and any copyright that applicable law affords you over those materials. Note that the definition of how unique and distinct a work needs to be to be copyrightable is jurisdiction dependent and can vary over time as legal systems evolve and adapt to new legal challenges.

Thanks for the reply joepal - yeah I wasn't really sure how "unique and distinct" a cartoon of the pose would be in order for it to be technically owned/copyrighted. Thanks for giving your interpretation!

My intention is to make a donation or continued donation to the MH project based on a sales % instead of putting up the notice purely so that anyone who might want to do what I would be doing with the cartoons would have to do their research and track down MH themselves.
